OVERVIEW
This Application ("App") is operated by Go Electric Stations S.r.l.s.. All information, tools and services made available through this App are provided subject to your acceptance of these Terms of Service, including all terms, conditions, policies and notices set out herein.
By using our App and/or purchasing any of our services, you agree to use our "Service" and to be bound by these Terms of Service, including any additional terms, conditions, policies, the Privacy Policy and the Cookie Policy referenced herein or made available by hyperlink. These Terms of Service apply to all users of the App, including, without limitation, users, suppliers, customers, merchants and contributors of content.
Please read these Terms of Service carefully before accessing or using the App. If you do not agree to all of the terms and conditions contained herein, you may not access the App or use any of the services provided.
Any new features, updates, modifications or tools added to the App shall also be subject to these Terms of Service. You may review the most recent version of the Terms of Service at any time on this page.
SECTION 1 - APP TERMS
By accepting these Terms of Service, you confirm that you have reached the age of majority in your country of residence.
You may not use our products or services for any unlawful or unauthorized purpose, nor may you violate any applicable laws in your jurisdiction while using the Service, including, without limitation, copyright laws.
You must not transmit any worms, viruses or any code of a destructive nature.
Any breach or violation of these Terms shall result in the immediate termination of the Services.
SECTION 2 - GENERAL CONDITIONS
Please note that content transmitted through the App (excluding credit card information and personal data) may be transferred without encryption and may involve:
(a) transmissions over various networks;
(b) modifications required to conform and adapt to the technical requirements of connecting networks or devices.
Credit card information is always encrypted during transmission over networks.
You agree not to reproduce, duplicate, copy, sell, resell or otherwise exploit any portion of the Service, the use of the Service, access to the Service, or any contact available through the App or website through which the Service is provided, without our prior written consent.
Section headings are included for convenience only and shall not affect the interpretation of these Terms.
SECTION 3 - CHARGING SERVICE
The paid charging service is available exclusively at charging stations that support the initiation of charging sessions through the NextCharge App and/or the NextCharge RFID Card/Token.
For further information, please visit nextcharge.app.
All payment transactions are processed by Go Electric Stations S.r.l.s.
3.1 Charging via Credit Card, PayPal and Satispay
Charging sessions may be paid for using VISA, VISA Electron, Mastercard and American Express payment cards, as well as PayPal and Satispay.
Payment security is ensured through SSL encryption technology.
Transactions appearing on your payment card statement will be identified as Go Electric Stations S.r.l.s. or NextCharge.
Payment details are required only when initiating the first charging session.
Users are responsible for ensuring that the email address provided is accurate, as receipts and/or invoices will be sent to that address.
The previously used payment card will remain available for future charging sessions.
For security reasons, only the last four digits of the payment card together with its type (VISA, Mastercard or American Express) will be displayed.
Payment cards may be removed or updated at any time by contacting
support@nextcharge.app.
We reserve the right to refuse the Service to any user, at any time and for any reason.
3.2 Charging with the NextCharge Wallet
To use the NextCharge Wallet, you must first top up your Wallet balance by accessing the App menu and selecting the section displaying your nickname and Wallet balance after registering an account. Wallet top-ups may be made using a payment card or Satispay. PayPal is not available for Wallet top-ups. Your available Wallet balance will be displayed in the same section of the App.
Charging sessions paid using the Wallet will be deducted from the available Wallet balance. If the remaining Wallet balance is insufficient to cover the total cost of a charging session, the outstanding amount will be used to automatically top up the Wallet by charging the payment method originally used to purchase the Wallet credit, solely for the purpose of completing payment for the ongoing charging session. Such amount will be immediately used for that charging session, leaving the Wallet balance at zero.
The Wallet is linked to the associated RFID Card/Token. Consequently, all charging sessions initiated using the RFID Card/Token will be charged to the corresponding Wallet.
Users may also enable the automatic top-up feature, which automatically reloads the Wallet whenever the available balance falls below the applicable threshold. In such cases, the Wallet top-up amount will be automatically charged to the associated payment method. The applicable threshold is displayed directly within the App.
The purchase of Wallet credit constitutes solely the purchase of prepaid Wallet credit and does not represent payment for any individual charging session. Any tax documentation relating to the purchase of Wallet credit and to subsequent charging sessions will be issued in accordance with the applicable tax legislation.
Wallet credit remains valid for 12 months from the date of the most recent Wallet top-up. Consequently, the associated RFID Card/Token may be used for as long as the Wallet credit remains valid. Each new Wallet top-up automatically extends the validity of the Wallet credit for a further 12 months.
Once this 12-month period has expired, the Wallet credit may no longer be used to pay for charging sessions. However, the remaining Wallet credit will be retained for an additional period of one (1) month, during which the user may exclusively perform a new Wallet top-up. If a new Wallet top-up is completed within this additional period, the remaining Wallet credit will be fully reactivated and its validity will automatically be extended for a further 12 months.
If no Wallet top-up is completed during the additional one-month period, any remaining Wallet credit shall expire and will be removed from the Wallet.
For further information regarding the operation of the NextCharge Wallet, please refer to Section 4 of these Terms and Conditions.
3.3 Charging with Coupons
To use a Coupon, the user must possess a personal coupon code associated with a specific credit balance. The cost of the charging session will be charged directly against the corresponding Coupon balance.
3.4 Charging Service Fees and Payments
In order to use the charging service, the user is required to pay the applicable fees for each individual charging connector. The applicable fees are displayed directly in the App by selecting the relevant connector or by pressing the Start button.
Charging fees may consist of one or more pricing components, including, but not limited to, session fees, time-based fees and energy-based fees. Where multiple pricing components apply, they shall be cumulative.
Charging fees may be changed at any time without prior notice. Users are therefore responsible for verifying the applicable price displayed in the NextCharge App before starting a charging session.
Payment for the charging service will be processed using the payment method selected by the user. If payment cannot be successfully collected, Go Electric Stations will notify the user and may make multiple attempts to recover the outstanding amount.
Such attempts may be carried out using any payment method associated with the user's account.
Should all payment attempts fail, Go Electric Stations reserves the right to suspend the user's account until a valid payment method is provided.
If such suspension remains unresolved for more than thirty (30) days, Go Electric Stations may initiate legal proceedings for the recovery of the outstanding amounts.
Certain Charging Stations may be subject to an additional fee, the amount of which is explicitly displayed within the App before the charging session is started. For users subject to Italian tax legislation, such additional fee is excluded from VAT pursuant to Article 15 of Italian Presidential Decree No. 633/1972.
Such additional fee shall only apply if, after the charging session has ended, the user leaves the vehicle connected to the charging station or, where applicable, exceeds the maximum parking time indicated for that Charging Station.
3.5 Credit Solvency Guarantee
To guarantee payment of the charging service, Go Electric Stations may apply a pre-authorization to the selected payment method.
The amount of the pre-authorization varies depending on the Charging Station and is clearly displayed in the App before the charging session is started. The maximum pre-authorization amount is EUR 100.
The pre-authorized amount will be released within one (1) hour after the charging session has been completed, once the Charging Station has notified Go Electric Stations that the session has ended and the charging session is no longer displayed within the App.
If the charging session cannot be finalized because the Charging Station has not yet transmitted the charging data, the pre-authorized amount may remain temporarily blocked for a maximum period of five (5) days.
When using the NextCharge Wallet, if the available Wallet balance is lower than the required pre-authorization amount, a pre-authorization request will be made against the payment method associated with the user's account.
If, at the end of the charging session, the Wallet balance is insufficient to cover the total amount due, the pre-authorized amount will be used where its value is equal to or greater than the outstanding amount. Otherwise, a new payment transaction will be processed using the selected payment method and the pre-authorized amount will be automatically released.
Each charging attempt, including an unsuccessful charging attempt, results in a separate pre-authorization and may therefore cause multiple pre-authorized amounts to be held simultaneously.
User Responsibilities
The user is responsible for ensuring that the payment method associated with their account remains valid and operational and that sufficient funds are available to cover the full cost of the charging service.
In the event of payment issues or technical problems affecting the selected payment method, it is the user's responsibility to update the payment information or contact Customer Support in order to avoid payment defaults.
3.6 Charging Session Processing
Go Electric Stations processes charging sessions in real time.
The charging cost will be charged to the selected payment method or deducted from the applicable Coupon once the charging data has been received from the Charging Station or, in the case of roaming, from the relevant charging station operator.
For Fast Reservations ("Arrival within 15 minutes"), which allow users to reserve a Charging Station for up to fifteen (15) minutes, the reservation fee (Charging Start Fee) will only be charged if the charging session is successfully started.
For Scheduled Reservations, the reservation fee is charged in advance at the amount displayed in the App and is non-refundable regardless of the actual use of the reserved charging session.
Once payment has been completed, the user will receive, by email at the address associated with the account, a receipt and/or invoice containing the details of the charging session and/or reservation.
Go Electric Stations reserves the right to refuse any order where false personal information or payment details are provided, where the user has previously breached obligations towards Go Electric Stations, or where spending limits have been exceeded.
If the holder of the payment card disputes a transaction relating to a charging session, Go Electric Stations reserves the right to seek reimbursement directly from the user, who shall remain liable for the disputed amount.
Go Electric Stations further reserves the right to introduce, without prior notice, additional restrictions designed to prevent fraudulent use of the Service.
Go Electric Stations may amend these Terms at any time. Any updated Terms shall become effective upon publication on this page and shall apply exclusively to charging sessions completed after their publication.
3.7 Limitation of Liability
The user acknowledges that all services provided through the NextCharge App are used entirely at the user's own risk. The services are provided on an "as available" basis. Go Electric Stations makes no representation or warranty that the Service will meet the user's expectations or operate without interruption or malfunction. Go Electric Stations shall not be liable for any claim arising from the user's inability to access or use the Service, regardless of the cause.
The provisions set out in this Section 3 shall be deemed accepted upon submission of the purchase order.
SECTION 4 - NextCharge Wallet and RFID Card/Token
The NextCharge Wallet is an electronic wallet that may be used exclusively to pay for charging sessions carried out at charging stations supporting NextCharge services.
The available Wallet balance may be used to pay for charging sessions initiated through the NextCharge App and/or the RFID Card/Token associated with the user's account, according to the charging methods supported by the individual Charging Station.
Where available in the country of use, the RFID Card/Token is linked to the user's Wallet and allows charging sessions to be started without using the NextCharge App.
Information regarding availability, issuance, applicable fees and related conditions is available directly within the NextCharge App or on the NextCharge website and may vary depending on the country.
The procedures for topping up the Wallet, the operation of the automatic top-up feature, the validity of the Wallet balance and the RFID Card/Token, together with the relevant conditions of use, are governed by Section 3.2 of these Terms and Conditions.
Should the Wallet balance expire and be removed in accordance with Section 3.2, the user may request a refund by contacting
support@nextcharge.app.
Go Electric Stations may issue the refund by re-crediting the Wallet or, where requested by the user and technically feasible, to the payment method originally used to purchase the Wallet credit.
The applicable refund procedure will be communicated when the request is submitted.
SECTION 5 - Plug&Charge
The Plug&Charge service, where available, enables charging sessions to start automatically at compatible charging stations without the need to use the NextCharge App or the RFID Card/Token, through the automatic recognition of a vehicle previously associated with the user's account. Use of the Plug&Charge service requires the vehicle to be associated in advance with the user's NextCharge account and the availability of a NextCharge Wallet with available credit. Charging sessions started through Plug&Charge shall be charged exclusively to the NextCharge Wallet associated with the user's account, in accordance with these Terms and Conditions. Associating a vehicle with the user's account constitutes permanent authorization for Plug&Charge to automatically start charging sessions until such association is revoked by the user. The user agrees to promptly remove the vehicle from their account in the event of sale, transfer, theft or loss of possession of the vehicle. The service is available exclusively for compatible vehicles and charging stations and may be activated, suspended, modified or discontinued by Go Electric Stations at any time, including only for specific vehicles, charging stations or categories of users. The user is responsible for all charging sessions started through Plug&Charge using a vehicle associated with their account, including where the vehicle is used by third parties, until the service is disabled or the vehicle is removed from the user's account. Removing the vehicle from the account or disabling the service shall not affect charging sessions already started before such change has been registered within the NextCharge systems. If, for technical reasons, the Plug&Charge service is unavailable or does not allow a charging session to be started, the user may use any other charging session authentication method supported by the charging station, including the NextCharge App or the RFID Card/Token, where available. Go Electric Stations does not guarantee the continuous availability of the Plug&Charge service, the proper operation of which also depends on the compatibility of the vehicle, the charging station and the services provided by third parties necessary for the operation of the system. Accordingly, Go Electric Stations shall not be liable for any malfunction, unavailability or failure to start a charging session resulting from such circumstances.
SECTION 6 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if the information made available through this App is inaccurate, incomplete or out of date.
The content available through the App is provided for general information purposes only and should not be relied upon as the sole basis for making decisions without consulting more accurate, complete or up-to-date sources of information.

We reserve the right to refuse any order placed through the App.
Such restrictions may apply to orders placed under the same user account, using the same payment card and/or the same billing information.
Should an order be modified or cancelled, we may attempt to notify the user using the email address, billing address or telephone number associated with the account.
We further reserve the right to limit or refuse orders which, at our sole discretion, appear to have been placed by dealers, resellers or distributors.
Users may enable or disable electronic invoicing directly within the App.
Users are responsible for ensuring that all billing information provided is complete and accurate.
Once saved, such information will remain associated with the account even if electronic invoicing is subsequently disabled.
Invoices and receipts may be downloaded directly from the Transactions section of the App.
Requests for electronic invoices relating to transactions completed before electronic invoicing was enabled must be submitted within twelve (12) days from the date on which payment for the charging session was completed.
Users agree to provide accurate, complete and up-to-date account and payment information and to promptly update such information whenever necessary, including email addresses, payment card details and expiration dates, so that payments may be processed correctly and communications may be delivered when required.

Accordingly, we may edit, copy, publish, distribute, translate or otherwise use any Comments in any medium without obligation to:
(1) keep any Comment confidential;
(2) provide compensation for any Comment;
(3) respond to any Comment.
We reserve the right, but undertake no obligation, to monitor, edit or remove any content that we determine, at our sole discretion, to be unlawful, offensive, defamatory, threatening, obscene, infringing or otherwise objectionable.
Users warrant that any Comments submitted do not infringe the rights of any third party, including intellectual property, privacy or other proprietary rights, and do not contain unlawful, defamatory, abusive or malicious material, including malware or computer viruses capable of interfering with the operation of the Service.
Users may not use false identities or misleading email addresses nor otherwise misrepresent the origin of any Comments.
Users remain solely responsible for the content and accuracy of any Comments submitted.
Go Electric Stations accepts no responsibility for Comments published by users or third parties.

Except where required by applicable law, we undertake no obligation to update, amend or clarify information contained within the Service, including pricing information.

SECTION 18 - TERMINATION
These Terms of Service shall remain effective until terminated by Go Electric Stations.
The user may terminate these Terms of Service at any time by notifying Go Electric Stations that they no longer wish to use the Services or by ceasing to use the App for a period of at least one (1) year.
Any obligations and liabilities incurred by either party before the termination date shall survive the termination of these Terms for all purposes.
If, in our sole discretion, you fail, or we suspect that you have failed, to comply with any provision of these Terms of Service, we may terminate these Terms at any time without prior notice.
In such circumstances, you shall remain liable for all amounts due up to and including the termination date, and we may deny you access to all or part of the Services.
SECTION 19 - ENTIRE AGREEMENT
These Terms of Service, together with any policies, notices or operating rules published by Go Electric Stations through the App, constitute the entire agreement between the user and Go Electric Stations regarding the use of the Service. They supersede all prior or contemporaneous agreements, communications, negotiations and understandings, whether oral or written, relating to the same subject matter. Any ambiguity in the interpretation of these Terms shall not be construed against the party responsible for drafting them.
SECTION 20 - GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of Italy. If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions shall remain valid and fully enforceable.
